1. Introduction
Welcome to Indian Swad Kitchen (referred to as “we,” “us,” or “our”), operating the website indianswadkitchen.ca (the “Site”). These Terms and Conditions govern your use of our Site and the purchase of products offered by us. By placing an order on our Site, you agree to be bound by these T&C.
2. Products
Product: Currently, We specialize in the sale of Indian Desi Ghee (Clarified Butter).
Quality & Nature: Our ghee is a home-based, handcrafted food product. While we maintain the highest standards of hygiene and quality control, variations in color, texture, and aroma may occur due to the handcrafted nature of the product and the natural ingredients used. We are food safety certified and we do our due diligence to keep the process clean and hygienic.
Allergens: Ghee is a milk product and contains dairy. Customers with severe dairy allergies should exercise caution.
3. Ordering and Payment
Order Confirmation: All orders are subject to acceptance and availability. Once you place an order, you will receive an email confirmation. This confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell; it simply confirms that we have received your order.
Pricing: All prices listed on the Site are in Canadian Dollars (CAD) and are subject to change without prior notice. Applicable sales taxes will be added at checkout.
Payment: We accept payment methods as indicated on our Site (e.g., Debit Card, Credit Card, Google Pay, Apple Pay, etc.). Orders will not be processed until payment has been received in full.
4. Shipping and Delivery
Processing Time: As our ghee is a freshly prepared product, orders typically require 2-4 business days for processing before shipment.
Shipping Areas: We currently deliver in Saskatoon, SK. Currently Shipping to all Canada with Additional Shipping costs.
Shipping Charges: Shipping charges will be calculated and displayed at the checkout based on your location and the size of your order.
Delivery Risk: We are not responsible for delivery delays outside of our control (e.g., those caused by the courier service, weather, or incorrect address provided by the customer). Once the product has been handed over to the courier, the risk of loss and title for the product passes to you.
5. Cancellations, Returns, and Refunds
Cancellations: Orders may only be canceled within within 24 Hours of purchase by contacting us directly. Once an order has been shipped, it cannot be canceled.
Returns: Due to the perishable and consumable nature of our product (ghee), we do not accept returns.
Refunds/Replacements (Non-Returnable Goods): A refund or replacement will only be considered in the following limited circumstances:
- The product arrived damaged during transit (proof of damage, including photographic evidence, is required within 3 days of delivery.
- An incorrect item was sent by mistake.
If you believe you are entitled to a refund or replacement under these terms, please contact us immediately at swadkitchen18@gmail.com. We reserve the right to deny any refund or replacement if the above conditions are not met.
6. User Obligations
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.
7. Intellectual Property
All content on the Site, including the logo, text, graphics, and product images, is the property of Indian Swad Kitchen and is protected by copyright and other intellectual property laws.
8. Limitation of Liability
Indian Swad Kitchen shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our products or services, even if we have been advised of the possibility of such damages.
